Terms of Service
Please read these terms carefully before using the CASTOVIA platform. By creating an account or using our services, you agree to be bound by these terms.
1. Platform Description
CASTOVIA is a managed SaaS platform for professional, licensed IPTV operators. We provide the infrastructure, management tools, and API compatibility layer that enables operators to manage their streaming services efficiently.
CASTOVIA is a platform provider only. We do not create, host, distribute, or control any media content. All streams, channels, VOD content, and other media are sourced, managed, and distributed entirely by our customers (the "Operators") using their own infrastructure and content sources.
CASTOVIA acts as a configuration and management layer — the actual streaming traffic flows directly between the Operator's servers and their end-users. CASTOVIA does not proxy, cache, or store any media content.
2. Content Rights & Operator Responsibilities
By using CASTOVIA, each Operator represents, warrants, and agrees that:
- They hold all necessary licenses, rights, and permissions for any content they distribute through the platform, including but not limited to live TV channels, VOD content, series, and radio streams.
- They are in full compliance with all applicable copyright laws, broadcasting regulations, and content distribution agreements in every jurisdiction where their content is made available.
- They accept sole responsibility for the legality, licensing, and rights clearance of all content they manage through CASTOVIA.
- They will not use the platform to distribute unauthorized, pirated, or illegally obtained content of any kind.
- They will maintain proper geo-restriction configurations as required by their content licensing agreements.
3. Copyright Infringement & Notice-and-Takedown
CASTOVIA respects intellectual property rights and complies with applicable copyright laws, including the DMCA (Digital Millennium Copyright Act) and the EU Copyright Directive.
If you believe that content managed through our platform infringes your copyrights, you may submit a takedown notice to:

Your notice must include:
- Identification of the copyrighted work claimed to be infringed
- Identification of the material that is claimed to be infringing
- Your contact information (name, address, email, phone)
- A statement of good faith belief that the use is not authorized
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature
Upon receipt of a valid notice, CASTOVIA will promptly investigate and, where appropriate, disable the Operator's access to the relevant content configurations or suspend/terminate the Operator's account.
4. Geo-Blocking & Regional Compliance
CASTOVIA provides geo-blocking capabilities that Operators must use to ensure content is only accessible in regions where they hold valid distribution rights.
Operators are solely responsible for correctly configuring geo-restrictions in accordance with their content licensing agreements. Failure to properly configure geo-blocking does not transfer liability to CASTOVIA.
5. Account Suspension & Termination
CASTOVIA reserves the right to immediately suspend or terminate any Operator account, without prior notice, if:
- The Operator is found to be distributing content without proper licensing or authorization
- A valid copyright infringement notice is received and the Operator fails to demonstrate valid rights
- The Operator violates any applicable laws or regulations
- The Operator's use of the platform poses a legal risk to CASTOVIA or other users
6. Limitation of Liability
CASTOVIA provides the platform "as is" and makes no warranties regarding the availability, accuracy, or reliability of the service beyond commercially reasonable efforts.
CASTOVIA shall not be liable for:
- Any content distributed by Operators through the platform
- Any copyright or licensing violations committed by Operators
- Temporary service interruptions or data transmission delays
- Any indirect, incidental, or consequential damages arising from use of the platform
CASTOVIA's total liability shall in no event exceed the fees paid by the Operator during the 12 months preceding the claim.
7. Data & Privacy
CASTOVIA stores Operator configuration data (streams, bouquets, subscriber lines, server settings) in our secure cloud infrastructure. This data is retained for the duration of the Operator's subscription and for a reasonable period after account termination.
CASTOVIA does not access, monitor, or store any end-user viewing data or media content. All streaming traffic flows directly between the Operator's servers and their end-users.
8. Modifications to Terms
CASTOVIA reserves the right to modify these terms at any time. We will notify all active Operators of material changes via email at least 30 days prior to the changes taking effect. Continued use of the platform after such notification constitutes acceptance of the modified terms.
9. Governing Law & Jurisdiction
These terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
